Our principles
- Plain language, no fine print.
- We follow European consumer and privacy rules for everyone, wherever you live.
- If we can’t work it out together, you can simply go to court.
- You can always stop, delete your account and take your data with you.
- Questions about how we work, about the AI or about your privacy? Send us a message. We are happy to talk.
1. Who we are
In short: BeNice.family B.V. makes the BeNice app.
The BeNice app helps separated parents bring calm and clarity to their contact about the children. The app is made by BeNice.family B.V., Haagweg 33 L, 2681 PA Monster, the Netherlands, Chamber of Commerce (KvK) 96487569. When we write “we” or “BeNice” in these terms, we mean BeNice.family B.V. By “the app” we mean the BeNice app.
Questions about these terms? Email support@benice.family. On request, we will send you these terms free of charge.
2. When these terms apply
In short: to everyone who uses the app.
2.1. These terms apply to everyone who uses the BeNice app, including if you sign up through the App Store or Google Play. If you do not agree to them, you cannot use the app.
2.2. You must be 18 or older to create an account. If you use the app as a professional, for example to try it out or with a trial licence through the portal, these terms also apply to you, in addition to the agreements you make with BeNice as a professional.
2.3. We may change these terms at any time. The latest version always applies. If anything changes about your rights or about what you pay, we will let you know by email in advance.
2.4. Agreements that differ from these terms only apply if we have made them with you in writing. Email counts as writing.
2.5. You can read how we handle your data in our privacy policy.
3. Definitions
In short: what a few words in these terms mean.
- Subscription: the agreement that gives access to the paid features of the app.
- Subscription period: the term of your subscription, monthly or yearly, as you choose when you sign up.
- Family circle: the place in the app where you and the other parent arrange everything around your children together.
- Free trial: the period in which you can use the app for free. It ends automatically. You pay nothing unless you take out a subscription yourself.
- Linked professional: a professional who is linked to your family circle through BeNice for Professionals.
- Professional: someone who supports families, such as a mediator, lawyer, social worker or coach.
- Start date: the day your trial period or subscription begins.
- Processors: services we need that process personal data on our behalf. You can read which ones they are in our privacy policy.
4. Your account
In short: your account is yours alone and you keep your sign-in details to yourself.
4.1. To use the app, you create an account.
4.2. You choose your own sign-in details, such as your email address and a strong password.
4.3. You only create an account for yourself and you do not give anyone else access to your account.
4.4. Keep your sign-in details and password secret. Whatever happens after someone has signed in with your details is your responsibility. Your responsibility ends as soon as you tell us that someone else knows your password.
4.5. You can delete your account in the app settings. This does not automatically end your subscription. You stop your subscription in the App Store or Google Play.
4.6. You need a good internet connection to use the app. Your phone and your internet connection are your own responsibility.
5. The subscription
In short: you can try it for free and your subscription runs through the App Store or Google Play.
5.1. You can try BeNice free for 7 days. If the other parent joins within that time, you both get 7 extra free days.
5.2. One subscription covers your whole family circle. The other parent does not need to pay separately.
5.3. We do not ask for payment details for the free trial. After the free trial, you decide for yourself whether to take out a subscription.
5.4. You choose the subscription period when you sign up.
5.5. Your subscription renews automatically for the same period, unless you end it.
5.6. You can end your subscription before the end of your subscription period. You do this in the App Store or Google Play, where you took out the subscription.
5.7. You can withdraw from (cancel) your subscription within 7 days of the start date. To ask for a refund, go to the App Store or Google Play. Apple’s or Google’s rules apply there.
6. Price and payment
In short: you pay through the App Store or Google Play, and a new price only applies from your next period.
6.1. You see the price in the app and in the App Store or Google Play before you pay. All prices include VAT.
6.2. We may change our prices. We will let you know about a price change by email at least 30 days in advance.
6.3. If you already have a subscription, the new price does not apply during your current subscription period. Until the end of that period, you pay the price you agreed to.
6.4. You can end your subscription before the new price takes effect. Sometimes the App Store or Google Play asks for your consent first.
6.5. You pay through the App Store or Google Play.
6.6. We may later offer extra features or services that you pay for in a different way, for example directly through our website. Additional terms will then apply to those, which we will announce in advance.
7. If you work with a linked professional
In short: these terms also apply to you when a linked professional is involved.
If a professional creates your family circle through BeNice for Professionals, or if you link a professional yourselves, these terms apply to your use of the BeNice app.
If the linked professional pays for your family circle, you do not need your own subscription as long as the professional pays. If that stops, you can take over the family circle with your own subscription.
You can read in our privacy policy what a linked professional can see and when you can unlink them. Separate agreements with BeNice apply to the linked professional themselves.
8. BeNice Solo
In short: with BeNice Solo, you can use BeNice even if the other parent does not take part. Your messages go by email, and the other parent can always stop them.
With BeNice Solo, you send your messages by email to the other parent, even if they do not use the BeNice app. Only use the other parent’s email address for this, and only for contact about your children.
Here too, the Feedback Coach and the Filter look over the messages, and the rules in article 10 apply in the same way.
The other parent can always stop the emails. We will then stop forwarding messages until the other parent sends an email again.
9. BeNice is a tool, not an advisor or a care provider
In short: BeNice supports you, but does not replace a lawyer, a therapist or an emergency service.
- BeNice is not a legal advisor and not a therapist. The BeNice Coach thinks along with you and helps you communicate calmly, but does not give legal advice and is not therapy or professional care.
- A parenting plan from the app is not automatically valid or binding. That depends on your situation and the country where you live. Get advice on this from a professional, such as a mediator or lawyer.
- BeNice is not flawless. The Feedback Coach and the Filter can make mistakes. So always read an important message carefully yourself. If in doubt, open the original message by pressing and holding the filter icon next to the message.
- BeNice is not an emergency service. Are you or your child in danger? Call 112 or the emergency number in your country, or seek professional help right away.
10. How we treat each other
In short: the app protects you both from threats, accusations and intimidation, and the same rules apply to both of you.
What you receive goes through the Filter. It takes accusations and emotions out of a message, so you see the core of it. Messages that contain a threat, for example, are stopped by the Feedback Coach before they reach you.
This is how we treat each other, in the app and in BeNice Solo:
- you do not threaten, intimidate, insult or harass the other parent;
- you do not try to get around the Feedback Coach or the Filter;
- you do not share anything illegal, or images of someone else that you are not allowed to share;
- you only use your own account, and you do not create an account in someone else’s name.
If you send many messages in a row without the other parent responding, the app pauses sending for a while. We call this the cool-down period. Once the other parent responds, or the pause is over, you can continue.
If the app is misused, for example for spam or for something it is not meant for, we may block your account. We will then tell you why. If you disagree, you can reply to support@benice.family.
11. Messages
In short: a sent message is final. The Filter can change what the recipient sees, but the original can always be opened.
11.1. Once a message is sent, you can no longer edit or delete it. This also applies to the other parent and to a linked professional. That way, the conversation in the app stays exactly as it really happened.
11.2. Messages between parents may be automatically adjusted, filtered or rewritten by BeNice, for more calm and clarity. Parts of a message may be changed, hidden or left out. The original message is kept and the recipient can always open it.
11.3. What you receive through the app may therefore differ from what the other parent originally wrote. You cannot rely on the adjusted version to claim any rights.
11.4. You can report a message if the Filter or the Feedback Coach did not handle it well. Someone from our team will then review it to improve the app. You agree that we may view your messages and use them to improve the app, if the recipient reports them.
12. Availability and maintenance
In short: we work every day to make sure the app works well and safely. If you still notice that something is not working, let us know and we will look into it as soon as possible.
12.1. You can use the app as long as you have a subscription. We do our best to keep the app available 24 hours a day, 7 days a week. We are responsible for how the app works and for its maintenance. For this, we also rely on other companies’ services. If there is an outage on their side, we cannot always fix it ourselves, but we do what we can to keep the impact as small as possible.
12.2. Because of planned or unplanned maintenance, the app may sometimes be unavailable for a short time. We plan maintenance so that it causes you as little inconvenience as possible.
12.3. We may change the app and add, change or remove features.
12.4. We work every day to make sure the app works well. Like any app, it may still contain an error now and then. If something is not working as you expect, you think there is an outage, or you have an idea to make the app better, let us know via support@benice.family. We will look into it as soon as possible.
13. Ending your access
In short: with good reason, we can end your subscription.
13.1. We may end your subscription and exclude you from the app if we have a valid reason to do so. In that case, we do not have to refund any amounts or pay any compensation.
13.2. A valid reason exists in any case if:
a) you break the law or these terms;
b) you do not meet your payment obligations;
c) you use the app for something it is clearly not intended for.
14. Others who work for us
In short: we may bring in others, and your agreement is with BeNice, not with one person.
14.1. We may have others carry out some or all of the work, if we consider this necessary to deliver the app properly. Think of the services listed in our privacy policy.
14.2. You enter into the agreement with BeNice, not with a specific person at BeNice. That is why three articles of the Dutch Civil Code do not apply: 7:404 (the work must be done by a specific person), 7:407 paragraph 2 (if several people do the work, each of them is jointly and severally liable) and 7:409 (the agreement ends if that person dies).
15. Force majeure
In short: we are not liable in the event of force majeure.
15.1. We are not liable if we cannot meet our obligations because of force majeure (circumstances beyond our control). This includes, for example, a failure of a service we use that we can do nothing about, a hack or an internet outage. The same applies the other way around: if you cannot meet your obligations because of force majeure, you are not liable for that either.
15.2. If the force majeure lasts longer than 3 months, you can end your subscription. You are then not entitled to compensation.
16. Intellectual property
In short: the app belongs to us and what you put in it belongs to you.
16.1. We, or our licensors or suppliers, are the sole owner of all rights to the app, now and in the future, such as copyright, trademark rights, design rights, patent rights, the source code and the know-how behind it.
16.2. You only receive the right to use the app. That right is non-exclusive and you may not transfer it or license it to anyone else.
16.3. What you put in the app remains yours. You can read more about this in article 17.
17. Confidentiality and privacy
In short: what you put in the app remains yours, we treat it confidentially and no one at BeNice reads your messages.
17.1. We treat what you entrust to us confidentially: anything you have told us is confidential, and anything that is confidential by its nature. Your personal data always falls under this.
17.2. Everything you put or share in the app, such as messages, photos, documents and information about your children, remains yours. We may analyse it to the extent necessary to make the app work and to improve it. We do not use it commercially without your explicit consent. Where possible, we analyse it in a way that cannot be traced back to you. We only store information about your children so that you can keep it for yourself or share it with the other parent. To improve the app, we count how much and what kind of information is stored, without the content.
17.3. No BeNice employee reads your messages. Only when someone reports a message can an employee who is authorised to do so view it, to assess the report and to improve the app. This is done in accordance with the GDPR (in Dutch: AVG).
17.4. We protect your personal data in accordance with the GDPR. You can read more about this in our privacy policy.
18. Liability
In short: our liability is limited, except where there is intent or gross negligence.
18.1. We are not liable for loss or damage caused by the use of our website or the app, or by them being unavailable. Anything you do based on our website, the app or information from us is at your own expense and risk.
18.2. We are not liable for loss or damage caused by incorrect or unlawful use of the app, by you or by others.
18.3. We do our best to support messages automatically by filtering, rewriting or hiding them. We cannot guarantee that this is always done completely, correctly or without errors. You remain responsible for the content of your own messages. We are not responsible for loss or damage because a message was adjusted or did not arrive, except where there is intent or gross negligence on our part.
18.4. We are not liable in the event of force majeure, as described in article 15.
18.5. We are only liable for direct loss that is the direct and sole result of our failure to perform our obligations.
18.6. If we are liable after all, our liability is limited to the amount of subscription fees you paid in the 12 months before the event that caused the loss or damage.
18.7. We store your data carefully. We are not liable for damage to or loss of data stored with us or with others.
18.8. These limitations do not apply if the loss or damage is caused by intent or gross negligence on our part.
18.9. You indemnify us against all third-party claims, such as fines, costs and damages, that relate to your use of the app.
19. Complaints, law and courts
In short: email us with a complaint. Dutch law applies.
19.1. If you have a complaint, email support@benice.family. We will respond within one month.
19.2. Dutch law applies to these terms.
19.3. If we cannot work it out together and it goes to court, that will be the District Court of The Hague. If we bring the case, you have one month to choose the court that has jurisdiction by law instead. This is usually the court where you live.
20. Final provisions
In short: if one rule is invalid, the rest still stands.
20.1. If any part of these terms is void or is set aside, the rest still applies. The invalid part will be replaced by a rule that comes as close to it as possible.
20.2. You may not transfer your rights and obligations under these terms to anyone else without our written permission.
20.3. These terms are also available in Dutch. In case of differences, the Dutch text prevails.
