BeNice Privacy Policy
Version 2.0, effective from 11 October 2026. You can read the previous version here.
This privacy policy covers the BeNice app and the website benice.family. If you work as a professional with BeNice for Professionals, we make separate arrangements with you about that.
Our principles
- BeNice is a Dutch company. We follow European privacy law, the GDPR (in Dutch: AVG), and we are supervised by the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
- The core of the BeNice app runs in the European Union: your messages, your data and the AI. For a few parts, such as paying through Apple and Google, we use services outside the EU, with agreements that provide European protection.
- No one at BeNice reads your messages, unless a message is reported.
- We never sell your data. What you put in the BeNice app, such as your messages and your children’s information, we never use for advertising.
- You stay in control: what you share, with whom, and when you stop.
- Questions about how we work, about the AI or about your privacy? Send us a message. We are happy to talk.
1. Who we are
In short: BeNice.family B.V. is responsible for your personal data (the "controller" under the GDPR).
The BeNice app is for separated parents who want calm and clarity in their contact about the children. The app is made by BeNice.family B.V. When we write “we” or “BeNice” in this privacy policy, we mean BeNice.family B.V. By “the app” we mean the BeNice app.

2. Who this privacy policy is for
In short: for parents who use the app, for visitors to the website, and for the other parent who receives email from us through BeNice Solo.
You must be 18 or older to create an account. The app is not meant for children. Parents can store information about their children; you can read about that in article 6.
3. What data we use and why
In short: we only use what we need, and for each purpose we say why we need it.
| What | What for | Legal basis |
|---|---|---|
| Your name, email address and sign-in method (including if you sign in with Google or Apple) | Your account | Performance of the contract |
| What you put in the app: messages, calendar, custody schedule, Expenses, photos, documents, the parenting plan and your conversations with the BeNice Coach | Making the app work and sharing with the other parent | Performance of the contract |
| Information about your children, such as school, allergies and medication, and contact details such as phone numbers and addresses of the school, GP or childcare | Sharing it with the other parent | Performance of the contract |
| Your subscription and free trial | Knowing what you can use, and our accounting | Performance of the contract and legal obligation |
| Your questions to support | Helping you | Legitimate interests |
| Your name, email address and message through the contact form on the website | Answering your question | Legitimate interests |
| How you use our website | Improving our website | Legitimate interests |
| Emails about your account and the service, such as activation, security, outages, your free trial and important changes | Keeping you informed of what you need to know | Performance of the contract |
| The newsletter, with new features, tips and offers | Keeping you up to date on BeNice | Consent |
| How you navigate through the app | Improving the app | Consent |
| Crash reports | Fixing errors | Consent |
| Speech to text through Apple or Google | Speaking instead of typing | Consent |
| Messages you report yourself | Improving the Feedback Coach and the Filter | Consent |
| Data needed to prevent misuse and keep the app secure | Security | Legitimate interests |
| Data we must keep or hand over by law, such as on an order from the police or the public prosecutor, or when reporting a data breach | Complying with the law | Legal obligation |
Performance of the contract: we need it to make the app work. Consent: only if you say yes, and you can always turn it off again. Legitimate interests: we have a good reason for it, and we weigh that against your privacy. Legal obligation: the law requires it of us.
Without your name and email address, we cannot create an account for you. Everything else is up to you.
If you put other people’s information in the app, such as the number of the GP or of a friend’s parents, only use it for caring for your children.
If you sign in with Apple or Google, they give us your name and email address, and with Google also your profile photo. We use that as the photo for your account in the app. If you choose “Hide My Email” with Apple, we only get a forwarding address from Apple, and we don’t see your real email address.
If you connect the calendar to your own calendar app, such as Google Calendar, Apple Calendar or Outlook, that app fetches your appointments through a personal link. Don’t share that link with anyone. You can always revoke it in the app.
You only get our newsletter if you sign up for it, through the app or the website. If you were already using the app before you could choose this, you may get it anyway. You can always unsubscribe, with the link at the bottom of every email.
4. Who can see your messages?
In short: you and the other parent, and no one else, unless you let in a professional yourself or report a message.
Your messages are meant for you and the other parent. We store them encrypted, on secure servers in the European Union.
The Feedback Coach automatically looks at your message at the moment you send it, and the Filter at messages you receive. No one reads your messages.
A small number of authorised staff members have technical access to our systems, to fix outages and keep the service secure. They are bound by confidentiality, sign in with two-step verification and do not read your messages.
Do you want someone from our team to look at a message, for example because the Feedback Coach or the Filter didn’t work well? Then report it in the app. Only then does someone from our team look at that message. The same applies if the other parent reports a message of yours.
If you use BeNice Solo, the same applies to the email between you and the other parent. We also store it encrypted in the European Union, and no one reads it there either.
Have the two of you linked a professional? Article 7 explains what they can see.
5. AI in the app
In short: AI helps you communicate calmly. Your messages are not used to train AI.
The Feedback Coach looks at messages you send, the Filter at messages you receive. To assess a message properly, the AI also looks at the earlier messages in the same conversation.
The Feedback Coach automatically holds back messages that contain a threat, for example. Did the Feedback Coach hold back a message of yours when nothing was wrong with it? Then report it. Someone from our team will look at it, so we can improve it.
The BeNice Coach remembers a number of facts about your situation. You can see and change what it remembers in the BeNice Coach, under Coach memories.
The AI comes from Google and TensorX. Both run in the European Union and do not train their AI on your data.
We store what the Feedback Coach suggested and what the Filter changed with the message. That way you can look back at what the Coach suggested, and the recipient can always open the original message. We also keep track of how often messages are changed or held back. Those figures contain no text and no names.
6. Information about your children
In short: you decide who sees it, and we do not use the content for anything else.
In the app you can store information about your children, such as school, allergies and medication, and contact details such as phone numbers and addresses of the school, GP or childcare, to share it with the other parent. For each item you decide whether only you see it, or the other parent too. We only store this information so that you can keep it for yourself or share it with the other parent. To improve the app, we count how much and what kind of information is stored, without the content.
In the app you can also store sensitive information, for example about your children’s health. That is your own choice. By entering it, you give us consent to store it. You decide who sees it: the other parent, or only you. We use it for nothing else, and you can always change or delete it.
7. If you work with a linked professional
In short: a linked professional only sees what you share, and you can always change that.
A professional, such as a mediator or social worker, can be linked to your family circle through BeNice for Professionals in two ways. We then call them a linked professional. Your family circle is the place in the app where you and the other parent arrange everything around your children together.
- You add a professional yourselves. Then you both have to agree. If the other parent wasn’t in the app yet, they choose for themselves when they join whether the professional sees their information.
- The professional, or the organisation they work for, creates the family circle for you. The invitation tells you what the professional can see. BeNice and the organisation agree together on who is responsible for what. The organisation will let you know.
For each item you decide yourself what you share: message statistics, your use of the app, your Expenses activity and the content of the chat. A professional does not read messages in the app. If sharing the chat is turned on for both of you, they can download the conversation. The download contains the messages as they were sent, including what the Filter had removed for the recipient. If one of you turns it off, they can’t.
If you merge an existing family circle with a circle a professional created, we first ask you what you want to share.
A professional can make their own notes about your family. You don’t see those, and the professional is responsible for them.
You unlink a linked professional together: one of you requests it in the app, the other agrees. You don’t need a subscription for that. As long as the professional’s organisation pays for your family circle, it isn’t possible. You can always turn off what you share, though.
If the professional stops paying, they stay linked until you unlink them. If you want to keep using the app after that, either of you can take over the family circle with your own subscription.
8. BeNice Solo and the other parent
In short: if the other parent doesn't use the app, they receive your messages by email, and they know their replies go through the Filter.
With BeNice Solo you send your messages by email to the other parent, even if they don’t use the app. The email goes through us, so your own email address stays hidden.
For the other parent. If you receive a message through BeNice Solo, we use your email address and your replies to keep track of the conversation. Your replies are assessed automatically and go through the Filter. Accusations and emotions are taken out, so the recipient sees the core. Your original reply is kept and the recipient can always open it. If you no longer want to receive messages, reply with “stop”. You can always email us at privacy@benice.family.
We do this because the parent who uses BeNice Solo has an interest in communicating with you calmly and safely about the children.
9. Notifications on your phone
In short: you choose whether notifications show the text of a message.
With a new account, notifications only show that there is a message, and who it is from. If you also want to see the text of the message, you turn that on in the app.
10. Photos
In short: we remove the location from your photos.
We automatically remove the location and other hidden data from photos you share, in the chat, in the Photo Diary and with receipts. A receipt itself often shows the name and location of the shop. We don’t remove that.
11. Usage analytics and crash reports
In short: only if you say yes, and without your messages.
If you give consent for usage analytics, we can see how you navigate through the app, for example whether you quickly find what you are looking for. Texts and photos are always made unreadable.
If you give consent for crash reports, we get a technical report when an error occurs: what went wrong, your phone model and the app version. Never your messages, names or photos.
You can always turn both off again in the app’s privacy settings.
12. Who we share data with
In short: only with services we need, and the core is in Europe.
In the European Union
- Google Cloud (EU): storage, sign-in, the Feedback Coach, the Filter, the BeNice Coach and our email
- TensorX (France, Ireland and Finland): second AI for the Feedback Coach, the Filter and the BeNice Coach
- Brevo (France): emails and newsletter
- Postscale (Estonia): email through BeNice Solo
- PostHog (Frankfurt, Germany): usage analytics, only with consent
- Plausible (EU): website visitor statistics, without cookies
Outside the European Union, based on the EU-U.S. Data Privacy Framework or the European Commission’s standard contractual clauses
- RevenueCat (US): subscriptions
- Apple and Google (US): payments, sign-in, notifications and speech to text, and on the website spam checks and, only with your consent, statistics and advertising
- Google Firebase Crashlytics (US and worldwide): crash reports, only if you give consent for them
- Anthropic (US): help answering your support questions, reviewing messages you report yourself, and fixing errors in the app
- YouTube (US): explainer videos in the app
These services may only use your data for what they do for us. If you pay or sign in through Apple or Google, their own privacy rules also apply. Websites we link to have their own privacy policies.
13. How long we keep your data
In short: no longer than necessary, and after that we delete it automatically.
| What | How long |
|---|---|
| Your account and everything you put in the app | Until you delete your account. If you don’t sign in for 24 months, you get an email; if you then don’t sign in for 60 days, we delete your account |
| Messages you report | 2 years. If we use a message to improve the Feedback Coach or the Filter, we first make it unrecognisable |
| Email through BeNice Solo | 30 days at Postscale. The conversation in the app for as long as your account exists; a full copy of each email for 90 days |
| Your questions to support | 2 years after the last contact |
| Emails from us (Brevo) | As long as your account exists, or until you unsubscribe |
| Usage analytics (PostHog) | 1 year; screen recordings 30 days |
| Statistics (Google Analytics) | 14 months; totals without personal data longer |
| Crash reports | About 90 days, at Google |
| Backups | Up to 14 weeks |
If you delete your account, we erase your data within 14 days, from our systems and those of the services we use. It stays in backups for up to 14 more weeks. Messages you sent to the other parent remain in their copy of the conversation.
14. How we protect your data
In short: encrypted, in Europe, and only accessible to those who need it.
Your data is sent and stored encrypted, on servers in the European Union. Only a small number of authorised staff members have technical access. They are bound by confidentiality and sign in with two-step verification. We only work with partners outside Europe under strict agreements that safeguard parents’ privacy.
You can lock the app with your fingerprint or face recognition, and give individual items in Shared Info extra protection. Your phone does that check itself. We never see your fingerprint or face.
15. Requests from police, judicial authorities and other agencies
In short: only if the law requires us to.
We only give your data to the police, judicial authorities or other agencies if the law requires us to, and never more than necessary. We let you know, unless the law forbids us to, for example during a criminal investigation. If you need your messages for legal proceedings, you can export them yourself in the app.
16. If something goes wrong
In short: we report it, and we let you know.
If there is ever a personal data breach, we report it to the Dutch Data Protection Authority and let you know if it affects you.
17. Your rights
In short: you can view, correct and have your data deleted, and you can do much of that yourself in the app.
You have the right to access your data, have it corrected (rectification) or deleted (erasure), restrict its processing, object to how we use it, and take your data with you (data portability). If you have given consent for something, you can always withdraw it. If we use your data based on legitimate interests, you can always object to that.
- You can arrange a lot yourself in the app: change your data, export your chat, change your privacy settings and delete your account.
- For everything else, email privacy@benice.family. We respond within one month.
- If you disagree with us, you can make a complaint to the Dutch Data Protection Authority, or to the data protection supervisory authority in the country where you live.
18. Cookies
In short: our cookie policy covers this.
You can read which cookies our website uses and how to turn them off in our cookie policy.
19. Changes
In short: if something important changes, we let you know.
We update this privacy policy when the app or the law changes. If something changes in what we do with your data, we let you know by email in advance. The date on which the current version takes effect is always shown at the top, and the previous version remains available to read.
This privacy policy is also available in Dutch. In case of differences, the Dutch text prevails.
